From 1st October 2008, it will be a legal requirement
for all those
wishing to sell/let/assign legal interests in
commercial property to
produce an Energy Performance Certificate. The
EPC and
recommendation report must be made available free
of charge by a
Landlord or Tenant seeking to dispose of commercial
property. The
guidance states that this must be provided at
the earliest
opportunity and no later than:
When any written
information about the building is provided in
response to a request for information received
from the prospective
tenant/purchaser: OR
When a viewing is conducted: OR
If neither of these occur, before entering into
a Contract to sell or
let.
We recommend that you consider having this report
carried out by an
EPC assessor at an early point in the marketing
campaign so as to meet
these requirements at the point of sale. The production
of an EPC is a
legal requirement and whilst we are not yet certain
of the exact
breach of legislation rules there is a potential
fine of up to £5,000
for non-compliance.
